Terms & Condition

Please read these Terms & Conditions before using any of World India Express's services.

Terms of Service: World India Express TERMS AND CONDITIONS OF CARRIAGE ("Terms and Conditions")

IMPORTANT NOTICE: When ordering services from World India Express, you, as the "Shipper," agree to these Terms and Conditions on your behalf and on behalf of anyone else with an interest in the shipment, effective from the moment World India Express accepts the shipments, unless otherwise agreed in writing by an authorized officer of World India Express.

"Shipment" refers to all documents or parcels traveling under one waybill, and may be carried by any means World India Express chooses, including air, road, or other carriers. A "waybill" includes any label, consignment note, or document produced by World India Express automated systems, and incorporates these Terms and Conditions. All shipments are transported with limited liability as outlined below. If the Shipper wants greater protection, insurance can be arranged at an extra cost (see below for details). "World India Express" refers to any member of the World India Express Network.

1. Customs, Exports, and Imports

World India Express may perform the following activities on the Shipper’s behalf in order to provide its services:

1.     Complete Documentation: Prepare any required documents, amend product or service codes, and pay any duties or taxes required by applicable laws and regulations.

2.     Forwarding Agent: Act as the Shipper’s forwarding agent for customs and export control purposes and designate a customs broker for customs clearance and entry.

3.     Redirection: Redirect the shipment to the Receiver’s import broker or another address upon request by any person whom World India Express reasonably believes is authorized.

4.     Customs Duties and Taxes: Any duties, taxes, or warehouse charges at the origin or destination customs (if the goods are returned to the origin) will be debited to the Shipper if the consignee refuses to pay. These charges are subject to the forwarding network and the destination country’s customs policies. World India Express is not responsible for customs duties, taxes, or warehouse charges.

5.     Address Verification: The Shipper is required to provide two or three authorized address proofs and a photo ID. If the Shipper fails to provide these documents, the shipment will be held and cannot proceed with forwarding or customs clearance.

6.     Detained or Stopped Shipments: If a shipment is detained or stopped by origin or destination customs for any reason, the Shipper or Consignee must provide all relevant documents or information. The Shipper or Consignee may also need to attend the customs procedures (if advised by World India Express). World India Express is not liable for any delays or issues caused by detained or stopped shipments at customs.

2. Unacceptable Shipments

The Shipper agrees that the Shipment is acceptable for transportation, and it will be considered unacceptable if:

It is classified as hazardous material, dangerous goods, prohibited, or restricted articles by IATA (International Air Transport Association), ICAO (International Civil Aviation Organization), ADR (European Road Transport Regulation on Dangerous Goods), or any relevant government department or organization.
No customs declaration is made when required by applicable customs regulations.
It contains counterfeit goods, animals, bullion, currency, banderols/tax stickers, bearer form negotiable instruments, precious metals and stones, real or imitation firearms, firearm parts, weapons, explosives, ammunition, human remains, pornography, illegal narcotics/drugs, or any other items that World India Express deems unsafe or illegal to carry.
The packaging is defective or inadequate for safe transport.
Note: If the shipment contains any prohibited, restricted, or undeclared goods (without prior information), World India Express reserves the right to detain the goods. If necessary, World India Express may forward the case to the relevant Indian legal or regulatory authorities (such as narcotics control or local police).

3. Deliveries and Undeliverable Shipments

Shipments cannot be delivered to P.O. boxes or postal codes. Shipments will be delivered to the Receiver’s address provided by the Shipper (in the case of mail services, this will be deemed the first receiving postal service), but not necessarily to the named Receiver personally.
Shipments to addresses with a central receiving area will be delivered to that area.
If the shipment is deemed unacceptable, under-valued for customs purposes, the Receiver cannot be identified or located, or the Receiver refuses delivery or to pay for the delivery, World India Express will make reasonable efforts to return the shipment to the Shipper at the Shipper’s cost. If this is not possible, the shipment may be released, disposed of, or sold by World India Express or its related forwarding network or agency, without liability to the Shipper or any other party. The proceeds will be applied to cover service charges, destination duties and taxes, warehouse charges, or destruction fees, which will be debited to the Shipper. The Shipper will be required to provide all necessary information if needed.

4. Inspection
World India Express has the right to open and inspect any shipment without prior notice. World India Express is not responsible if a shipment is opened for inspection by customs or other authorities.

5. Shipment Charges
World India Express calculates its Shipment charges based on the higher of actual weight or volumetric weight. The shipment may be re-weighed and re-measured by World India Express to verify this calculation. The Shipper is responsible for paying or reimbursing World India Express for all shipment charges, ancillary charges, duties, and taxes incurred by World India Express on behalf of the Shipper, Receiver, or any third party. This includes any claims, damages, fines, or expenses arising from the shipment being deemed unacceptable for transport. In case of any claim, the Shipper can follow the claim policy outlined in the Claim Section.

6. World India Express’s Liability
World India Express makes every effort to provide high-quality service through qualified and experienced executives. The company ensures that expert executives are assigned to handle goods pickup and all transportation services up to delivery. Note: Pickup executives are responsible only for the collection of the shipment. Once the shipment is picked up from the Shipper, any further queries should be directed to any of World India Express’s offices or branches. Pickup executives are not responsible for addressing any queries or concerns after the shipment has been collected.

7. Time Limits for Claims
All claims must be submitted in writing (verbal claims will not be accepted) to World India Express within three days after the delivery or within three days after the pickup (if the shipment has not been forwarded or connected) from the date World India Express accepted the shipment. Failure to submit a claim within this time frame will result in World India Express having no liability. Claims must be submitted by the authorized Shipper with the AWB (Air Waybill) copy. If the shipment has been delivered, the Shipper must also provide the complaint number from the delivery network. Claims related to delivered shipments will only be accepted when the Shipper provides the complaint number from the delivery network.

Note: Claims will only be accepted from the authorized Shipper.
8. Shipment Insurance*
World India Express can arrange insurance for the Shipper, covering the actual cash value of the Shipment in case of loss or physical damage, provided the Shipper completes the insurance section on the waybill or requests it from World India Express and pays the applicable premium. Please note that shipment insurance does not cover indirect losses or damages, or loss or damage caused by delays.

9. Delayed Shipments

World India Express will make every reasonable effort to deliver the shipment according to its regular delivery schedules, but these are not guaranteed and do not form part of the contract. World India Express is not liable for any damages or losses caused by delays. All deliveries are subject to origin and destination customs clearance.

10. Circumstances Beyond World India Express’s Control

“Force Majeure” events, such as earthquakes, cyclones, storms, floods, fog, war, plane crashes, embargoes, riots, civil commotion, or industrial action.
11. International Conventions

If the shipment is transported by air and the ultimate destination or stop is in a country other than the country of departure, the Montreal Convention or the Warsaw Convention (as applicable) will govern. For international road transport, the Convention for the International Carriage of Goods by Road (CMR) may apply. These conventions limit World India Express’s liability for loss or damage.

If re-packaging is required during import/export, World India Express will repack the shipment without prior notice. Any re-packaging charges and additional weight charges will be payable by the Shipper or Consignee.

14. Right to Change Forwarding Network and Repack Shipments

World India Express reserves the right to change the forwarding network and repack shipments as necessary, without prior notice to the Shipper. If, for any reason, the shipment is not forwarded by World India Express, the Shipper will need to collect it from the nearest branch as instructed. World India Express is not responsible for returning the shipment to the original Shipper under any circumstances.

15. Routing

The Shipper agrees to all routing and diversion decisions, including the possibility that the shipment may be carried through intermediate stops. If the shipment is routed according to the instructions of the Shipper or consignee, any charges for routing and address corrections will be borne by the Shipper, as per World India Express policies.

16. Governing Law

Any dispute arising under or related to these Terms and Conditions shall be subject to the non-exclusive jurisdiction of the courts in the country of origin of the shipment. The Shipper irrevocably agrees to this jurisdiction, unless contrary to applicable law.

17. Shipment Return Policy
